The following terms and conditions are in place to ensure we maintain a safe and fair online Purewater Products ecommerce website.
Acceptance of Terms and Conditions
By registering as a customer of Purewater Products and a user of the Purewater Products website you accept these terms and conditions. Should you choose not to accept these terms and conditions, you are not permitted to use the Purewater Products website.
These Terms and Conditions have the following expressions and meanings:
'Service', 'Services' means any service that is provided by the Purewater Products website;
'We' and 'Us' and 'Our' are reference to Purewater Products;
'You' and 'Your' are reference to users and/or browsers of the Purewater Products website;
'Website' means the Purewater Products website;
'Product' means any product that is offered for sale and/or purchase on the Purewater Products website;
'Customer', ‘Customers’ includes any person buying a service from the Purewater Products website;
Changes to Terms and Conditions
These terms and conditions may be changed from time to time. All changes will be effective immediately upon posting changes on the website. It is the responsibility of all Purewater Products customers to be familiar with the latest terms and conditions. Your on-going use of the Purewater Products website represents your agreement to these terms and conditions.
Guarantees
If you buy a product from the Purewater Products website and receive a faulty product or a product different from that which you purchased, please contact us to arrange for your purchase to be returned for a full refund or credit. No refund will be given for product returned in an unsellable condition or for product not found to be fualty on inspection of the returned goods.
Price
All prices published on the Purewater Products website are in New Zealand dollars and include 15% Goods and Services Tax (GST). A courier fee will apply to all purchases made through the Purewater Products website. This fee is a flat charge of $6.00 for all non-rural deliveries nationwide, with a rural delivery fee of $10.00.
Confirmation of Order
All customers, including corporate customers, will receive an order confirmation via e-mail when placing an order through the Purewater Products website. Customers, following credit card payment, will also receive an invoice with their order.
Payment Terms
We accept payment for purchases made through the Purewater Products website via Visa and Master Card credit cards only. All charges are made in New Zealand dollars and include GST. We charge your credit card at the time of your purchase via the DPS secure payment system.
Product Guarantee
All products are guaranteed free of any manufacturing defects for a period of 12 months. In the event that you experience any product issues/problems please call us first and we’ll advise of the correct measures to remedy such problems. Our sole obligation will be to repair or replace any defective merchandise due to any manufacturing defects so long as the product has been correctly installed and complying with any Purewater Products recommendations. Purewater Products does not warrant damage resulting from misuse, incorrect installation or improper storage. Purewater Products is not liable for any incidental or consequential damage.
Delivery Policy
All goods are despatched by courier within 48 hours unless stated otherwise on the website for a particular product. Delivery times vary from 1-5 days subject to location throughout New Zealand. If a procduct ordered is out of stock and on back order, Purewater Products will advise the customer via e-mail on recieving their order and of the expected wait time for the product.
Return Policy
Any claims against purchases from Purewater Products must be made within 7 days of delivery, except where the claim is for a product manufacturing defect which products are guaranteed free of for a period of 12 months. Prior to returning goods all customers must first contact Purewater Products customer support and advise of the return of goods. All returned goods must be in the original packaging, undamaged, not used and accompanied with a copy of the invoice. In the event that a qualified Purewater Products technician finds no fault with the product, it may be returned to you at the discretion of Purewater Products with no refund provided.
All courier charges on returns are not refundable unless the return is due to a manufacturing defect, you receive goods different from that which you purchased or your goods are damaged in transit. If you do recieve a product which is faulty or different from that which you purchased, please contact us immediately to arrange return of the product. Our qulified technician will then inspect the returned product and if found to be faulty or different from that which you purchased, you will be reimbursed for the delivery charge. For goods damaged in transit, Purewater Products may refuse to exchange these damaged goods if you signed for them at the time of delivery, accepting the goods were recieved in good condition. Please ensure you check your goods for any damage prior to signing the delivery docket for your product.
Your Account
By registering as a user of the Purewater Products website you warrant that you have provided complete, accurate and current personal or business information. You must maintain and update your information held by Purewater Products to ensure it is kept current at all times. Purewater Products may phone or mail you to verify these details. Without limiting any other rights or remedies we may have, you agree not to permit any other person to use your details or customer information for the purchase of goods through the Purewater Products website.
We may, at our discretion, monitor your use of the Purewater Products website and restrict access to any content or services available.
Emails, Newsletters and Product Reminders
Purewater Products may send you emails relating to products purchased, transactions and other activities on the website, and for promoting and marketing other Purewater Products product and services to you including new product lines or product specials on offer. Purewater Products may also send regular electronic newsletters to cusotmers. Newsletters will contain clear and obvious instructions on how you can unsubscribe from the mailing list. You may also recieve a reminder that your filter/cartirdge is due for replacement. If you do not wish to recieve these reminders , please contact us to have your name deleted from our recall/reminder list.
Indemnity
Except where we have expressly accepted responsibility to you under these Terms, you will keep us protected against any legal action taken against us and pay us any costs, losses or expenses we incur in connection with your use of our website or any failure by you to comply with these Terms.
Termination
We reserve the sole discretion, without notice, to terminate your account and ability to buy product or use our website services if we believe that you have breached these Terms and Conditions. We may also in our sole discretion and without notice to you, stop providing some or all of the product and/or services or the Purewater Products website as a whole. Any termination by us under this term will not affect any rights or responsibilities which are intended to continue, or come into force after that time.
Intellectual Property Rights
Purewater Products (and Purewater Products suppliers as the case may be) own all proprietary and intellectual property rights on and in the Purewater Products website (including text, content, graphics, logos, images, icons) and the software and architecture forming Purewater Products product, services and the website. You may not without our prior written permission, in any form or by any means copy, reproduce, adapt, display, distribute, publish or create derivative works from any part of the Purewater Products Website; or commercialise, copy, or on-sell any information, or items obtained from any part of the Purewater Products website.
Disclaimer
While the information contained in this website is accurate to the best of Purewater Products knowledge, it is not intended to be used to give medical or health advice.
Purewater Products accepts no liablilty for any damage to product or property in situations where water pressure exceeds 850kpa or 125psi or where Water Hammer is present and a pressure limiting device has not been installed.
General Terms
In the event of a dispute arising in relation to these Terms and Conditions, the New Zealand courts will have non-exclusive jurisdiction over such a dispute. If we do not exercise or enforce any right available to us under these Terms, this does not constitute a waiver by us of those rights. We may transfer this agreement or any benefit or obligation of this agreement to any person without notice to you. You may not transfer any benefit or obligation to any other person without our written consent. Each part of these Terms is separately binding. If for any reason any part cannot be relied on, all other parts remain binding.
Privacy Act 1993
If You are an individual, You have rights under the Privacy Act 1993 to access information held by Us, and to request the correction of such personal information. In respect of such personal information, You:
- Authorise Us to obtain personal information about You, via Your Registration Form and Your use of Purewater Products and Our Services.
- Authorise Us to use Your personal information for direct marketing and promotional activities, research and development purposes, identity verification, and otherwise in respect of the provision of Our Services to You.
- Agree that further notification to You of the purpose of the collection of Your personal information is unnecessary and non-compliance with the requirements of Principle 3 of the Privacy Act 1993 is authorised.
